Types of jurisdiction
In personam jurisdiction permits a court to enter a judgment that is personally binding on the
defendant, either ordering her to do or refrain from doing a certain act (equitable or
injunctive relief) or decreeing that the plaintiff may collect a certain amount of damages from
the defendant (legal relief).

Types of jurisdiction
In rem jurisdiction permits a court to adjudicate the rights of all claimants to a specific piece
of property, as in a condemnation proceeding.
At common law, only the legal “owner” of a right could bring an action for
infringement of that right. Since the common law did not recognize equitable interests
(e.g. rights of beneficiaries of various kinds of trusts, etc.), the holder of such an
interest could not sue at law for its enforcement, but instead had to rely on the legal
owner to bring suit. This burdensome practice has been abolished, and today, suit can
be brought only in the name of the real party in interest.
5.The real party in interest rule has two parts; the person who is suing must: 1. use her own
name as plaintiff,
2.have a legal right to enforce the claim in question under the applicable substantive law.
6. Venue is a statutory limitation on the geographical location of litigation to prevent a
