Настоящий договор составлен между Афанасьевой
Светланой Борисовной, именуемой в дальнейшем
«Заводчик», и Guillardeau Eugénie, именуемой в
дальнейшем «Новый владелец», о нижеследующем.
This contract is made between Afanasyeva Svetlana,
hereinafter called «Breeder», and Guillardeau Eugénie,
hereinafter called «New owner», about the following.
1. Предмет договора
1.1. Заводчик обязуется передать в собственность
Нового владельца, а Новый владелец обязуется принять
Животное с целью развития породы Сибирская на
территории Франции и безвозмездно передать на развитие
питомника LucianAurora сумму, указанную в п.1.2.:
1. The Subject of the Agreement
1.1. Breeder undertakes to transfer the ownership of the
Animal to the New owner, and the New owner undertakes to
accept the Animal for the purpose of developing Siberian breed
in France and donate the amount specified in paragraph 1.2 to
the development of LucianAurora cattery:

1.2. Условия оплаты
Стоимость животного составляет 1300 EUR + один
алиментный (бесплатный) котенок любого пола по праву
первого выбора из любого помета от LucianAurora
Rocketman по усмотрению Заводчика (Афанасьева
Светлана Борисовна).
Это является добровольным и благотворительным
взносом на развитие питомника LucianAurora. Стоимость
не включает в себя расходы по транспортировке животного.
1.2. Payment terms
Cost of the Animal is 1300 EUR + one alimentary (free)
kitten of any gender by the right of first choice of Breeder
(Afanasyeva Svetlana) from any litter from LucianAurora
Rocketman.
It's a voluntary and charitable contribution to the
development of the cattery LucianAurora. The cost doesn't
include the cost of transporting the Animal.
2. Условия продажи
2.1. Животное передается Новому владельцу в
возрасте 4 месяцев и старше.
2.2. К моменту переезда к Новому владельцу
Животное дважды вакцинировано против панлейкопении,
ринотрахеита и кальцивироза, однократно привито против
бешенства, обработано от глистов, чипировано.
2.3. Вместе с Животным Новому владельцу
передаются следующие документы:
Ветеринарный паспорт с отметками о прививках,
родословная, наклейки микрочипа, договор передачи
котенка.
2. Terms of Sale
2.1. The Animal moves to the New owner at age of 4
months and older.
2.2. By time the Animal moves to the New owner the
Animal is twice vaccinated against panleukopenia,
rhinotracheitis and feline calicivirus, once vaccinated against
rabies, treated for worms, microchipped.
2.3. New owner gets the following documents with the
Animal:
Veterinary passport with stamped vaccinations, pedigree,
microchip stickers, kitten contract.
3. Условия оплаты
3.1. Новый владелец имеет право зарезервировать
Животное в любом возрасте после рождения. Стоимость
резервирования составляет 350 евро. Заводчик имеет право
публиковать информацию о зарезервированном Животном
в социальных сетях с пометкой «резерв». Статус «резерв»
означает приоритетное право Нового владельца на
приобретение Животного.
3. Payment terms
3.1. The New owner can reserve the Animal at any age
after the birth. The cost of the deposit is 350 euro. The Breeder
publishes information about the Animal in status «reserved».
The status «reserved» means the priority right of the New
owner to purchase the Animal.
Если Новый владелец отказывается от
зарезервированного Животного по независящим от
Животного или Заводчика причинам, то Заводчик не
возвращает Новому владельцу аванс, публикует
информацию о Животном с пометкой «свободен», и имеет
право предлагать Животное третьим лицам.
3.2. Новый владелец имеет право оплатить полную
стоимость Животного до момента передачи Животного в
собственность Нового владельца. В этом случае Заводчик
имеет право публиковать информацию о Животном с
пометкой «продан». Заводчик обязуется не предлагать
третьим лицам Животное, за которое Новый владелец
выплатил полную стоимость. Если Новый владелец
отказывается от Животного по независящим от Животного
или Заводчика причинам, то Заводчик не возвращает
Новому владельцу полную стоимость Животного,
публикует информацию о Животном с пометкой
«свободен», и имеет право предлагать Животное третьим
лицам.
3.3. Новый владелец доплачивает остаток стоимости
Животного не позднее, чем за неделю до момента его
передачи.
3.4. Оплата осуществляется по реквизитам, которые
предоставляет Заводчик Новому владельцу. Стоимость
Животного считается выплаченной при поступлении
денежных средств на счет карты или банковского счета
Заводчика.
3.5. В случае смерти, потери и, соответственно,
невозможности получения алиментного котёнка от
LucianAurora Rocketman, Новый владелец обязуется
выплатить Заводчику 2000 евро (две тысячи евро).
If the New owner refuses to take the Animal because of
reasons beyond the Animal or the Breeder, the Breeder doesn’t
returns deposit to the New owner, publishes information about
the Animal in status «available», and has the right to suggest
the kitten to other people.
3.2. The New owner can pay the full cost of the Animal
before the Animal leaves the Breeder. In this case, the Breeder
publishes information about the Animal in status «sold». The
Breeder doesn’t offer the Animal to other people. If the New
owner refuses to take the Animal because of reasons beyond
the Animal or Breeder, the Breeder doesn’t returns the full cost
to the New owner, publishes information about the Animal in
status «available», and has the right to suggest the kitten to
other people.
3.3. The New owner pays the rest the Animal’s cost not
later than one week prior to the date of leaving Breeder.
3.4. The payment is made by the details offered by the
Breeder. The cost of the Animal is considered to be paid when
the Breeder receives the money on the card, bank account.
3.5. In case of death, loss and, accordingly, inability to
get an alimentary kitten from LucianAurora Rocketman, the
New owner pays to the Breeder 2000 euro (two thousands
euro).
4. Права и обязанности Заводчика
4.1. Заводчик имеет право выяснить условия
содержания у Нового владельца до подписания Договора.
В случае неудовлетворительных условий содержания и
отказа Нового владельца от улучшения условий
содержания Заводчик имеет право отказать Новому
владельцу в приобретении Животного.
4.2. Заводчик имеет право получать
правдивую
информацию о здоровье и содержании Животного у
Нового владельца. В случае неудовлетворительного
содержания животного Заводчик имеет право забрать его
от Нового владельца со всеми регистрационными и
выставочными документами без компенсации Новому
владельцу затрат на приобретение, содержание и
экспонирование Животного.
4.3. Заводчик гарантирует, что на момент переезда к
Новому владельцу у Животного отсутствуют эндо- и
эктопаразиты, оно не страдает хрониче скими
заболеваниями, у Животного отсутствуют видимые
признаки грибковых, вирусных, бактериальных и / или
генетических заболеваний.
4.4. Заводчик гарантирует, что Животное передается
Новому владельцу свободным от любых прав третьих лиц
(включая арест и залог).
4. The rights and obligations of the Breeder
4.1. The Breeder has the right to ask the New owner
about living conditions prior to the signing of the Contract. In
case of unsatisfactory conditions and refusal of the New owner
to improve the conditions of living, the Breeder has the right to
refuse the New owner in the acquisition of the Animal.
4.2. The Breeder has the right to get truthful information
about the health and living conditions of the Animal from the
New owner. In case of poor living conditions of the Animal the
Breeder has the right to take the Animal from the New owner
with all documents without compensation of expenses on
acquisition, maintenance and showing the Animal to the New
owner.
4.3. The Breeder guarantees that by the time of the
Animal’s move to the New owner the Animal doesn’t have
endo- and ectoparasites, the Animal doesn't suffer from chronic
diseases, the Animal doesn’t have visible signs of fungal, viral,
bacterial and / or genetic diseases.
4.4. The Breeder guarantees that the Animal transferred
to the New owner is free from any third party rights (including
arrest and bail).
5. Права и обязанности Нового владельца
5.1. Новый владелец имеет право в течение 3
календарных дней после передачи Животного провести за
свой счет любые дополнительные обследования Животного
в лицензированном ветеринарном учреждении (осмотр и
консультации у ветеринара, лабораторные обследования,
УЗИ и т.д.). В случае выявления состояния нездоровья
Дальнейшие действия Сторон указаны в п. 7.3.
5. Rights and obligations of the New owner
5.1. The New owner has the right to examine the Animal
at his/her own expense within 3 calendar days after coming of
the Animal to the New owner’s home in licensed veterinary
establishment (examination and consultation with a
veterinarian, make laboratory tests, ultrasound, etc.). In case of
state of the illness further actions of the Parties are written in
paragraph 7.3.
5.2. Новый владелец имеет приоритетное право
обращаться к Заводчику за консультациями по содержанию
и уходу за Животным.
5.3. Новый владелец обязан за свой счет приобрести
и установить необходимые предметы и иное оборудование,
обеспечивающие комфортные и безопасные условия
содержания Животного в доме Нового владельца и во всех
иных помещениях, в которых Животное будет содержаться
постоянно или временно (городская квартира, загородный
дом, дачный участок и т.д.), а также приобрести и
использовать необходимые предметы и иное оборудование,
обеспечивающие комфортные и безопасные условия
перевозки Животного всеми видами т ранспорт а
(переноска).
5.4. Новый владелец имеет право экспонировать
Животное на выставках различных фелинологических
систем за свой счет. Животное не имеет дефектов,
препятствующих выставочной карьере по любой
фелинологической системе. Новый владелец обязан
выставлять Животное только здоровым и по сле
соответствующей подготовки внешнего вида (грумминг
профессиональными средствами, с подстриженными
когтями и т.д.). Новый владелец имеет право обратиться к
Заводчику за помощью в подготовке Животного к участию
в выставке кошек.
5.5. Новый владелец гарантирует, что Животное не
будет передано третьим лицам, сдано в аренду без
письменного согласия Заводчика, а также никогда не будет
передано в магазин или на рынок для перепродажи, приют
для домашних животных, исследовательскую лабораторию,
цирк.
5.6. Новый владелец берёт на себя ответственность
за адапт ацию Животного в своём доме (при
консультационной поддержке Заводчика), включая
адаптацию других животных в доме, членов семьи, соседей
и т.д. В случае возникновения любых проблем, не
связанных со здоровьем Животного, оно может быть
принято Заводчиком обратно без возврата его стоимости.
5.7. Содержание Животного включает, но не
ограничивается следующими принципами:
Ж и в о т н о е д о л ж н о п р о хо д и т ь е ж е г о д н ы й
профилактический ветеринарный осмотр и ежегодную
ревакцинацию. В случае болезни Животное должно
получить своевременную и адекватную ветеринарную
помощь.
Животное может находиться на улице только в
вольере или на поводке. Свободный выгул Животного
запрещён.
В комнате, в момент нахождения в ней Животного,
не открывать окна в режим «проветривание» (открыто
вверх, а не в сторону) во избежание несчастных случаев
(удушение Животного).
Животное нельзя оставлять без присмотра дольше,
чем на 1 сутки.
Нельзя допускать контактов Животного с любыми
другими животными, чье состояние здоровья вызывает
сомнения.
Животное не должно содержаться в клетке, кроме
временной необходимости при карантине, подтвержденной
ветеринарным свидетельством.
Запрещается онихэктомия (удаление фаланг пальцев
вместе с когтями), а также любые действия, которые могут
нанести вред Животному, включая, но не ограничиваясь:
подрезание голосовых связок, обрезание усов, бритье и/или
стрижка шерсти.
5.2. The New owner has the priority right to contact the
Breeder for advice on maintenance and care of the Animal.
5.3. The New owner has to at his/her own expense to
purchase and install the necessary items and equipment to
ensure comfortable and safe conditions of living of the Animal
in home of the New owner, and in all other areas where the
Animal will be kept permanently or temporarily (city
apartment, villa, house building, etc), and acquire and use the
necessary items and other equipment to ensure a comfortable
and safe conditions of transportation of the Animal by all
modes of transport (carry bag).
5.4. The New owner has the right to show the Animal on
cat shows of various feline systems at his/her own expenses.
The Animal doesn’t have defects that prevent show career in
any feline system. The New owner is obliged to show only
healthy Animal, after appropriate preparing (professional
grooming, clipping claws, etc). The New owner has the right to
contact Breeder and ask for help in preparing the Animal to the
cat show.
5.5. The New owner guarantees that the Animal won’t
be transferred to third parties or leased without the consent
letter of the Breeder, and will never be handed over to the store
or at the market for resale, a shelter for domestic animals, a
research laboratory, a circus.
5.6. The New owner takes the responsibility for the
adaptation of the Animal in his/her house (with consulting
support of the Breeder), including adaptation of other animals,
family members, neighbors, etc. In case of any problems not
related to the Animal health, the Animal can be taken back by
the Breeder without returning Animal’s cost.
5.7. Keeping the Animal include but don’t limit the
following principles:
The Animal has to undergo an annual preventive
veterinary inspection and annual revaccination. In the case of
disease the Animal should receive timely and adequate
veterinary care.
The Animal can be on the street only in cage or on a
leash. Free walking of the Animal is prohibited.
It’s prohibited to open windows into «airing mode» (up,
not sideways) when the Animal is in the room to avoid
accidents of smothering of the Animal.
The Animal can’t be left unattended for more than 1 day.
It's prohibited to the Animal to have any contact with
other animals whose health status is in doubt.
The Animal shouldn’t be kept in a cage except cases of
quarantine, confirmed by a veterinary certificate.
Onychectomy (removal of the phalanges with claws)
and any actions that may cause harm to the Animal are
prohibited: vocal cord trimming, clipping the whiskers, shaving
and/or shearing wool, etc.
Животное нельзя бить и пугать. При демонстрации
нежелательного поведения со стороны Животного
обязательна консультация с Заводчиком.
Новый владелец обязуется кормить Животное
кормами только Premium или Super-premium класса по
рекомендации Заводчика и предоставлять Животному
необходимые витамины и другие пищевые добавки по
согласованию с Заводчиком.
У животного всегда должен быть доступ к свежей
воде.
Новый владелец обязан обеспечивать надлежащий
уход за внешним видом животного.
Животное должно иметь собственные игрушки,
место для сна и отдыха, место и посуду для приема пищи,
место для заточки когтей (когтеточка).
Соблюдение этих положений Договора Стороны
считают условиями нормального содержания Животного.
Отступление от указанных положений Стороны признают
доказательством жестокого обращения с Животным.
В случае нарушения Новым владельцем условий
п.5.7 Заводчик имеет право потребовать передачи ему
Животного со всеми регистрационными документами без
компенсации Новому владельцу затрат на приобретение и
содержание Животного. Также Новый владелец будет
обязан выплатить Заводчику штраф в размере двойной
стоимости Животного.
5.9. В случае невозможно сти дальнейшего
содержания Животного Новый владелец обязан:
Известить Заводчика о невозможности дальнейшего
содержания Животного;
Ни при каких обстоятельствах не выбрасывать и не
усыплять Животное;
П е р е д а т ь Ж и в о т н о е З а в од ч и к у с о в с е м и
документами;
Никому не передавать Животное без согласия
Заводчика.
Новый владелец имеет приоритетное право на
в о з в р ат Ж и в от н о го п р и и зм е н е н и и ж и з н е н н ы х
обстоятельств, если Животное к этому времени не обрело
новых Владельцев.
5.10. Новый владелец несет ответственность за
соблюдение условий Договора членами его семьи и
ближайшим окружением (например, гости дома и
обслуживающий персонал), которое будет иметь доступ к
Животное.
It's prohibited to beat and scare the Animal. In case of
demonstration of undesirable behavior by the Animal it is
obligatory to consult with the Breeder.
The New owner agrees to feed the Animal only with
Premium or Super-premium class food by the Breeder’s
recommendation and provide the Animal with essential
vitamins and other nutritional supplements in agreement with
the Breeder.
The Animal should always have access to the fresh
water.
The New owner is obliged to provide proper care of the
Animal’s look.
The Animal should have his/her own toys, a place to
sleep and rest, a place and dishes for meal, scratch post.
Compliance of these provisions of the Contract is
considered to be the normal conditions of the Animal welfare.
Deviation from these provisions Parties recognize as the
evidence of cruelty of the Animal.
If the New owner violate the conditions of paragraph
5.7, the Breeder has the right to demand the take of the Animal
with all registration documents without compensation to the
New owner of the cost of acquisition and maintenance of the
Animal. The New owner has to pay the Breeder a penalty equal
to the doubled cost of the Animal.
5.9. In case of impossibility of further keeping the
Animal the New owner has to:
Notify the Breeder of the impossibility of further
keeping the Animal;
Don't dispose of and not put asleep the Animal under
any circumstances;
Send the Animal to the Breeder with all documents;
Don’t transmit the Animal without the consent of the
Breeder.
The New owner has the priority right to return the
Animal if life circumstances change if the Animal will not find
new owners at this time.
5.10. The New owner is responsible for compliance of
the Contracts’s terms by members of his/her family and the
immediate environment (house guests, staff, etc) that will have
access to the Animal.
6. Общие положения
Стороны желают поддерживать хорошие отношения
в будущем, поэтому согласны выполнять следующие
условия:
6.1. Заводчик всегда доступен для Нового владельца
и согласен консультировать его по любым вопросам,
касающимся Животного.
6.2. Новый владелец регулярно информирует
Заводчика о развитии и здоровье Животного, особенно по
запросу Заводчика, и присылает фотографии не реже
одного раза в месяц в течение первого года жизни
Животного, а позже - не реже одного раза в три месяца.
6.3. Новый владелец осознаёт, что он приобретает
живое существо со своим характером и темпераментом,
оно может быть подвержено стрессовым ситуациям,
которые могут навредить его здоровью и психике. Решение
Нового владельца приобрести Животное является
осознанным и принятым обдуманно.
6. General Provisions
The Parties want to maintain good relations in the future
and therefore agree to fulfill the following conditions:
6.1. The Breeder is always available to the New owner
and agrees to advise him/her on any questions related to the
Animal.
6.2. The New owner has to regularly inform the Breeder
on the development and health of the Animal, especially by
Breeder’s request, and send photos at least once a month
during the first year of life of the Animal, and later - at least
once every three months.
6.3. The New owner is aware that he/she purchases a
live being with its own character and temperament, it may be
exposed to stressful situations that could harm its health and
psyche. The New owner's decision to purchase the Animal is
conscious and deliberately accepted.
В случае неудовлетворенности характером или
темпераментом Животного Новый владелец не имеет права
требовать замены Животного или возврата денег от
Заводчика.
6.4. Стороны согласны решать любые проблемы,
касающиеся Животного совместно и тайно, без участия
третьих лиц, уважая друг друга, личные права и
репутацию. Все вопросы, не урегулированные Договором,
о п р е д е л я ю т с я в с о о т в е т с т в и и с д е й с т ву ю щ и м
законодательством РФ.
In the case of dissatisfaction with the character or
temperament of the Animal the New owner has no right to
demand the replacement of the Animal or money back from the
Breeder.
6.4. The Parties agree to resolve any problems related to
the Animal together and in secret, without the participation of
third parties, respecting each other's personal rights and
reputation. All questions that are not governed by the contract,
determined in accordance with the law of the Russian
Federation.
7. Гарантии здоровья
7.1. Новый владелец подтверждает, что на момент
приобретения Животного никаких видимых признаков
нездоровья у котёнка и его родителей нет, а также Новый
владелец полностью удовлетворён содержанием животных
у Заводчика. К состоянию нездоровья не относятся
состояния, связанные с транспортировкой Животного,
нарушением режима кормлениям и / или содержания
Животного после момента приобретения или временные
ухудшения здоровья в период адаптации Животного в доме
Нового владельца, включающие, но не ограничивающиеся
с л ед у ю щ и м и п р оя вл е н и я м и : ч и ха н и е , н а с м о р к ,
слезотечение, расстройство пищеварения и аппетита,
парадоксальное поведение.
7.2. Для обеспечения гарантии здоровья, Новый
владелец обязан обеспечить карантин и изолировать
Животное от других животных в его доме в течение 7
календарных дней с момента переезда Животного к Новому
владельцу. В период карантина Новый владелец не имеет
права без согласования с Заводчиком менять вид корма,
спо собы кормления, а т акже проводить любые
манипуляции, касающиеся здоровья животного (включая
вакцинацию и дегельминтизацию), кроме случаев
необходимости экстренной медицинской помощи,
посещать выставки с этим Животным.
7.3. Если после дополнительного ветеринарного
обследования, проведенного за счет Нового владельца в
трехдневный срок после приобретения Животного, оно
признано нездоровым, то Новый владелец имеет право
вернуть Животное Заводчику с возвратом полной
стоимости Животного по Договору и без компенсации
расходов Нового владельца на транспортировку,
содержание и другие сопутствующие расходы. Если Новый
владелец не воспользовался правом возврата нездорового
Животного в трехдневный срок, то претензии по состоянию
Животного в дальнейшем не принимаются и возврат денег
после трехдневной гарантии, данной Заводчиком,
исключается.
7.4. Заводчик не несёт ответственность за любые
проблемы со здоровьем других животных Нового
владельца.
7. Health guarantees
7.1. The New owner confirms that at the time of the
Animal’s purchase the Animal and its parents have no visible
signs of illnesses and the New owner is fully satisfied with the
way the Animal is kept by the Breeder. The ill health condition
doesn’t cover those conditions that are associated with the
transportation of the Animal, violation of the feeding schedule
and/or the management of the Animal following the purchase
or temporary health deteriorations in the period of adaptation to
New owner’s home including but not limited to the following
manifestations: sneezing, runny nose, lacrimation, digestive
and appetite disorders, paradoxical behavior.
7.2. To ensure the health guarantee, the New owner has
to arrange quarantine and isolate the Animal from other animals
in his/her home for 7 days starting from the moment of the
Animal’s arrival to the New owner. In quarantine period, the
New owner doesn’t have the right to change the type of
nutrition, methods of feeding, attend shows with the Animal,
perform any manipulations that would affect the health of the
Animal (including vaccination and de-worming) except in cases
of the necessity of emergency medical treatment.
7.3. If the Animal is found unhealthy by a further
veterinary examination carried out by the New owner within 3
days after the arrival of the Animal, the New owner has the
right to return the Animal to the Breeder with the
reimbursement of the full cost of the Animal under the Contract
without the reimbursement of transportation, maintenance and
other related expenses to the New owner. If the New owner
doesn’t use the right, the health-related claims won’t be
accepted in the future, possibility of money refund is excluded.
7.4. The Breeder is not responsible for health-related
problems among other animals owned by the New owner.
8. Племенное качество животного
8.1 На момент передачи Животное имеет следующий
племенной класс - BREED (шоу перспектива).
8.2 Стороны признают ценность племенной работы
по улучшению породы Сибирская, в том числе регулярное
участие в выставках и разведение в соответствии с
племенными программами, которые согласованы
Заводчиком и Новым владельцем. Стороны признают, что
регулярное участие Животного в выставках служит
подтверждением ценности племенной работы Заводчика
как заводчика.
Исходя из этих положений, Стороны согласовали
следующие особые условия договора:
8. Animal’s breeding qualities
8.1 By the time of the transfer, the Animal is BREED
quality (show perspective).
8.2 Parties recognize the value of breeding work to
improve the Siberian breed, including regular participation in
cat shows and breeding in accordance with the breeding
programs that are agreed by both the New owner and the
Breeder. Parties recognize that the regular participation of the
Animal in cat shows confirms the value of breeding work of the
Breeder as a breeder.
Based on these statements, Parties agree on the
following specific terms of the Contract:
8.2.1. Животное может быть повязано только с
зарегистрированными кошками породы Сибирская.
8.2.2. Новый владелец обязуется вязать кота не чаще
пяти раз в двенадцать месяцев.
8.2.3. Кот является закрытым производителем
питомника Нового владельца. Новый владелец обязан
согласовывать все вязки с кошками вне питомника Нового
владельца с Заводчиком.
8.2.4. Новый владелец имеет право продать в
разведение (не кастрированными / не стерилизованными)
не более пяти котят-мальчиков и пятнадцати котят-девочек
от данного Животного за целую жизнь Животного.
8.2.5. Запрещены вязки с кошками из следующих
питомников: «Angel Neva», «Laguz Opila», «Zolotaya Orda»,
«Wonder Neva», «Arkaim», «Sofizar», «Vizantiyskiy

8.2.6. Питомник LucianAurora поддерживает высокое
качество программы разведения и серьезно относится к
тому, где будут жить котята с правом разведения, а также
котята PET класса. Новый владелец также обязуется
относиться серьезно и ответственно к выбору хозяина
будущих котят любого класса
8.2.7. Новый владелец обязан кастрировать /
стерилизовать котят, проданных не в разведение.
8.2.8. Новый владелец обязан прописывать в
контракте котятам, проданным в разведение, условия о
вязке, аналогичные изложенным выше в п.8 настоящего
договора.
8.3. В случае нарушения п.8.2. Новый владелец
обязуется выплатить Заводчику штраф в размере 10000
евро (десяти тысяч евро) за каждый нарушенный пункт.
8.2.1. The Animal can be mated only with registered
Siberian cats.
8.2.2. The New owner has to mate cat no more than 5
times in twelve months.
8.2.3. The Animal is closed sire of New owner’s cattery.
New owner has to coordinate all matings of the Animal with
cats not from cattery of the New owner with the Breeder.
8.2.4. The New owner has the right to sell no more then
five kittens-males and fifteen kittens-females from the Animal
in breeding (not neutered / not sterilized) for the Animal’s
lifetime.
8.2.5. Matings of the Animal with cats from the
following catteries are forbidden: «Angel Neva», «Laguz
Opila», «Zolotaya Orda», «Wonder Neva», «Arkaim»,
«Sofizar», «Vizantiyskiy Podarok», «Dikoe Pole». This
provision also applies to all animals bred at these catteries up
until the third generation.
8.2.6. LucianAurora cattery upkeeps the high quality of
the breeding program and is serious about places where kittens
with the right of breeding and pet quality kittens will live. The
New owner also has to show earnest and responsibility when
choosing new owners for kittens of any quality.
8.2.7. The New owner has to neuter / sterilize kittens
sold not for breeding.
8.2.8. The New owner has to include mating conditions
for kittens show/breed quality similar to those outlined above
in paragraph 8 of the present Contract.
8.3. If the New owner violate any of conditions written
in paragraph 8.2., the New owner has to pay the Breeder 10000
euro (ten thousands euro) fine for every violated condition.
9. Форс-мажорные обстоятельства
9.1. Ни одна из сторон не несет ответственности
перед другой стороной за невыполнение обязательств,
обусловленное обстоятельствами, возникшими помимо
воли и желания сторон и которые нельзя предвидеть или
избежать, включая объявленную или фактическую войну,
гражданские волнения, эпидемии, блокаду, эмбарго,
землетрясения, наводнения, пожары и другие стихийные
бедствия.
9.2. Сторона, которая не может исполнить своего
обязательства, должна известить другую сторону о
препятствии и его влиянии на исполнение обязательств по
Договору в разумный срок с момента возникновения этих
обстоятельств.
9.3. Дальнейшая судьба настоящего Договора в таких
случаях должна быть определена соглашением сторон. При
недостижении согласия стороны вправе обратиться в суд
для решения этого вопроса.
9.4. В случае болезни или гибели котенка до
передачи котенка Новому владельцу, Заводчик возвращает
Новому владельцу задаток.
9. Force Majeure
9.1. Neither Breeder or New owner is responsible to
each other for failure to fulfill the obligations due to
circumstances that have arisen against the will and wishes of
the Parties that can’t be foreseen or avoided, including declared
or undeclared war, civil unrest, epidemics, blockades,
embargoes, earthquakes, floods, fires and other natural
disasters.
9.2. The Party that fails to fulfill their obligation has to
notify the other Party of the impediment and its impact on the
performance of the obligations under the Contract within a
reasonable time starting from the date these circumstances
occurred.
9.3. The further fate of the Contract in such cases should
be determined by the agreement of the Parties. If no agreement
is reached, the Parties may refer to a court of law to resolve the
issue.
9.4. In the case of the Animals’s illness or death before
the Animal was transferred to the New owner, the Breeder
refunds the deposit to the New owner.
10. Прочие условия
10.1. Договор вступает в силу с момента его
подписания и прекращается надлежащим исполнением.
10.2. Договор составлен и подписан в двух
экземплярах, имеющих одинаковую юридическую силу.
Подписанные копии договора, переданные Сторонами друг
другу при помощи технических средств (сканнер, копир,
ксерокс, факс и т.д.) признаются обеими Сторонами и
считаются имеющими одинаковую юридическую силу.
10. Other terms and conditions
10.1. The Agreement enters into force when the Contract
is signed and shall terminate when properly executed.
10.2. The Contract is executed and signed in two copies
having equal legal force. The signed copies of the contract,
submitted by the Parties to each other with the help of technical
means (scanner, copier, copy machine, fax, etc.) shall be
accepted by both Parties and considered to have the same legal
force.
10.3. In case of changing the place of residence or
contact details Parties shall notify each other.

контактных данных Стороны обязаны уведомить друг
друга.
10.4. Новый владелец рассматривается, как
полноправный собственник Животного и несет за него всю
юридическую и морально-нравственную ответственность с
момента передачи Животного Новому владельцу после
подписания Договора и уплаты полной стоимости
Животного.
10.5. В связи с продажей Животного согласованы
следующие дополнительные условия:
Заводчик и Новый владелец могут использовать
фотографии и видеоролики данного животного в
рекламных целях (в том числе при размещении в
Интернет), независимо от того, кем именно они сделаны,
при обязательном указании полного имени животного и его
родителей, название питомника, имен заводчика и
владельца животного.
Запрещена продажа котят в разведение от данного
Животного в первом и втором поколении (т.е. детей
Животного и внуков Животного) в страны, раннее
входящие в состав СССР (исключение составляет заводчик
Афанасьева Светлана Борисовна, независимо от места ее
проживания).
Новый владелец обязан закрыть Животному высший
титул в двух фелинологических системах - TICA (титул
Supreme Grand Champion) и CFA (титул Grand Champion).
Животное обязано получить звание регионального
победителя (Regional Winner) в фелинологической системе
TICA или CFA. Как минимум один высший титул (Supreme
Grand Champion TICA или Grand Champion CFA) должен
быть закрыт Животным к его двухлетию (к 04 декабря 2021
года). Второй высший титул (Supreme Grand Champion
TICA или Grand Champion CFA) должен быть закрыт
Животным к его трехлетию (к 04 декабря 2022 года).
Звание регионального победителя TICA или CFA (Regional
Winner) должно быть получено Животным к его трехлетию
(к 04 декабря 2022 года). Закрытие других титулов
Животному приветствуется.
Животное должно посещать выставки не реже
одного раза в три месяца с момента прибытия к Новому
владельцу и до трёхлетнего возраста (дальше - по желанию
Нового владельца).
10.6. В случае нарушения п.10.5. Новый владелец
обязуется выплатить Заводчику штраф в размере 10000
евро (десяти тысяч евро) за каждый нарушенный пункт.
10.7. В случае расхождения русской и английской
версии договора преобладает первая (русская). В случае
возникновения споров, разбирательство должно проходить
в России, Татарстане, г. Казани, по российскому праву.
10.8. Подписи Нового владельца и Заводчика
удостоверяют полное их согласие со всеми условиями
настоящего Договора и подтверждают, что Заводчик
передал, а Новый владелец принял для домашнего
содержания Животное, указанное в п. 1.1.
10.4. The New owner is considered as the rightful owner
of the Animal and shall assume full legal and moral
responsibility for the Animal the moment the Animal is
transferred to the New owner after signing the Contract and
paying the full cost for the Animal.
10.5. The following additional conditions have been
agreed in connection with the sale of the Animal:
The Breeder and the New owner can use photos and
videos featuring the Animal for promotional purposes
(including posting on the Internet), regardless of whom they are
made providing the full name of the Animal and his/her
parents, name of the cattery and names of the Breeder and New
owner of the Animal.
Selling kittens for breeding from this Animal in the first
and second generation (i.e. children of the Animal and
grandchildren of the Animal) to the countries that were earlier
part of the USSR is forbidden (except for the Breeder
Afanasyeva Svetlana, regardless of where she is fostered).
The New owner has to earn the Animal the highest titles
in two feline systems - TICA (title Supreme Grand Champion)
and CFA (title Grand Champion). Also, the Animal has to get
Regional Winner title in feline system TICA or CFA. The
Animal has to close at least one highest title (Supreme Grand
Champion TICA and Grand Champion CFA) by the moment of
the Animal’s biennium (by 04 of December 2021). Second
highest title (Supreme Grand Champion TICA and Grand
Champion CFA) has to be earned by the Animal by the
moment of its triennial (by 04 of December 2022). Regional
Winner title has to be earned by the Animal by the moment of
its triennial (by 04 of December 2022). Earning other titles by
the Animal is welcomed.
The Animal has to go on shows not less often then once
in three months by the moment of Animal’s arrival to the New
owner and til the Animal’s triennial (after the Animal’s
triennial - at will of the New owner).
10.6. If the New owner violate any of conditions written
in paragraph 10.5., the New owner has to pay the Breeder
10000 euro (ten thousand euros) fine for every violated
condition.
10.7. In case of divergence of Russian and English
version the first version (Russian) prevails. In case of the
dispute, the proceeding should be taken place in Kazan,
Republic Tatarstan, Russia, under the Russian law.
10.8. The signatures of the New owner and the Breeder
shall certify their complete acceptance of all the terms under
the present the Contract and confirm that the Breeder has
handed over, and the New owner has accepted the Animal
referred to in paragraph 1.1 for home-keeping.
