I am convinced that this dialogue would be a landmark event in the present era of increasing specialization. We are extremely fortunate to have been propped up by IBA. We are all witnessing tremendous growth and changes between Indian and Russian business. Better communications creates more opportunities. We as IBA members are Fortunate to be able to contribute to the transfer of knowledge we haveacquired in Russia to the ones in India. As Thomas Friedman says "The world is flat." We are fortunate to be a part of this phenomenon. The 'Global Indian Origin' with its prime objective to highlight the lives and achievements of the prominent Indians in the foreign shores, has a noble mission to serve. Our mission that is to act as a guiding principle of its publication, seeks to glorify the India's traditional values, which have continued to guide the immigrants all along in the process of their accomplishments. By presenting the biographies of the eminent Indians in Russia, the magazine in this issue seeks to highlight their valuable contributions to the region in attaining its present prosperity of high order. In the process of bringing the India's diasporic community into the limelight, the role of the print media has been highly significant. Today, the literature on the diaspora is constantly on the increase and so is the position of the people whose increasing interest in the affairs of the immigrating community has helped in the publication of books, periodicals etc. all having their own distinct ways to present the lives and achievements of the immigrants. The magazine, Buisness Messenger that we have endeavoured to bring out as a biannual, aims basically to fill up a vacuum existing in the world of Indian Russian Business journalism. The Buisness Messenger with its prime objective to highlight the lives and achievements of the prominent Indians in Russia, has a noble mission to serve. Our mission that is to act as a guiding principle of its publication, seeks to glorify the India's traditional values, which have continued to guide the immigrants all along in the process of their accomplishments. Like this year when we celebrated HOLI FESTIVAL WITH 4th INDIAN DANCE COMPETITION, people showed their interest and hence making the event a memoriable event of the year. As well as in December when the IBA celebrated the DIWALI MELA, showing the rich Indian culture. However, the distinctive position of this magazine rests on its modus operandi, that is, the way of presentation of the biographies of the eminent personalities of Indian origin. Thus, following the distinct pattern of presentation, we have decided to include the personalities belonging to only one particular country in a single issue of this magazine. This is intended to make the readers enlightened about the eminent personalities living in a particular country more comprehensively. The socio-economic and cultural conditions of such personalities can be more revealing if these are studied within a particular geographical unit. This is in the background conceptual framework that has prompted us to undertake the publication of the Buisness Messenger. As the title of the magazine suggests, our basic concern is with the Indian Buisness spread out globally. By presenting the biographies of the eminent Indians in the Russia, this Buisness Messenger issue seeks to highlight their valuable contributions to the region in attaining its present prosperity of high order. We have made our best efforts to make the issue quite informative as well as interesting. However, it is our readers who are to decide about the veracity of our claim. While expecting their willing support for the continuity of our endeavour, we are to welcome their suggestions, if any, for improvement of this magazine. Moreover, while presenting the biographies for this issue, we had to be very selective for obvious reasons. We, however, assure that the important personalities who could not be included in this issue for certain unavoidable reasons, will find their due place in some other issues of the magazine just for the benefit of our readers. In fact, a wide coverage of the Indian personalities in overseas lands is our chief preoccupation, and which aims to establish the inter-linkages among them all. President IBA Moscow The current year promises to bring many changes and challenges, but will also present the Indian Business Alliance (IBA) with ample opportunities to make a difference in the Indian community in Russia. Last year was a very good year for the IBA. Today, the alliance represents over 150 businesses in Moscow alone. In 2009, we increased the membership by 10% and had success on our business-to-business gatherings. However, a lot still needs to be done, and the good news is that the current IBA leadership is ready to commit its time and resources to putting the alliance in a position to serve all of you better. For instance, and most importantly for the alliance members, we launched a new version of the IBA's official site in March 2010. The new site now lists all members' businesses in Russia. The upgraded site's other novelty is the special emphasis attached to all the entries on members' businesses. The crisis and its negative effects are still much around, albeit at a much less visible level than a year ago. Indeed, you may have heard some commentaries that 'while the recession may be over on Wall Street, it surely is not over yet on Main Street.' This is because Wall and Main Streets have different definitions of the word "over." Thus, according to Wall Street, the recession is over because 'having hit the bottom, the global economy has turned around, heading towards recovery.' On the other hand, Main Street - meaning businesses of all sizes - disagrees with Wall Street, saying 'things are not what they were in the pre-recession period.' This is true and may continue to be the case for awhile. Growth will come but, as experts have put it, ‘it is much easier to fall than to climb’. This is why the IBA, going forward, will try to help its members overcome the negative fallouts from the crisis as it has a very important role to play as we go forward through these changing times. This stems from the fact that the IBA's key role has always been to be the voice of the Indian business community in Russia. Besides, the IBA will retain its active in the community in 2010 by promoting its traditional family-oriented events (such as the IBA Family Picnic, etc.). Building a strong business community takes a team effort of all businesses. I would like to stress that it is our belief that through our active involvement, the community has become more cohesive and healthier. There are lots of plans on the table for the IBA. Please, join us in 2010 and participate actively as we execute these plans. The strength of IBA membership rapidly which shows the performance of the present team under the leadership of Mr. Sammy Kotwani 2. The success of first Indo - Russian business dialog which was inaugurated on 25th of September at Baltschug Kempinsky IBA has decided to make it a yearly event. 3. IBA committee for legal issues is working very closely with FMS to solve all immigration problems of its members. 4. IBA committee managed to establish a contact with UPDK to help its members for their rental problems. 5. A committee headed by S.V. President of IBA Mr. Atul Khurana is working with regional administration and Federal Assembly - The Parliament of Russia the Consul of Federation for the development of business also signed protocols of cooperation with Penza and Tver region. 6. Meeting with Indian and Russian customs chairmen. 7. Meeting with top officials of Ministry of health of Russian federation at Baltschug Kempinsky where one to one discussions were held between major Indian pharma companies and Russian officials. 8. AGM of IBA held at Durbar restaurant where 80% of the members participated. 9. Democratic elections of G.B. / M.C. on 01.11.09 where 129 members casted their votes. 10. The Strategic Partnership between India and the Russian Federation is the culmination of the long and multifaceted bilateral relations that have flourished between the two countries since the establishment of diplomatic relations in April 1947 and is a key foreign policy priority for both the Sides. This deepening partnership is not impacted in any way by the engagement of the two countries with the rest of the world. It is a time-tested and enduring friendship which is mutually beneficial and which has emerged as a factor of peace and stability in the region and the world. The Sides recognize that an effective response to the regional and global challenges in the future demands that India and Russia intensify their Strategic Partnership. As two large pluralistic democracies undergoing rapid economic transformation, India and Russia share many interests and viewpoints on global issues. They undertake to take steps to deepen bilateral cooperation and raise their Strategic Partnership to the next level. India and Russia value their Annual Summit as the principal vehicle to advance their Strategic Partnership. 2. India and Russia share the view that radical changes taking place in the international system, do not just pose new challenges and threats, but also provide opportunities to build a new, democratic and fair multipolar world order-based on collective approaches, supremacy of international law, and adherence to the goals and principles enshrined in the UN Charter. 3. India and Russia note that, in spite of a diverse range of international stake holders and the interlinking effects of globalization, a modern state is the main tool for reconciling public interest with securing the rights, freedoms and interests of individual citizens, and continues to be the basic building block of international relations. 4. The Sides emphasize that the emerging system of international relations should be based on the principle of indivisible security, have a universal character and should encompass all states and all major spheres of international relations. The Sides note that maintaining international peace involves equal security for all states without exception. The security of some states should not be achieved at the expense of the security of others. 5. The Sides are convinced that only collective efforts by the international community as a whole, can successfully meet challenges such as overcoming the global financial crisis, ensuring energy and food security and addressing an issue of global concern such as climate change. 6. India and Russia express their support for international efforts aimed at global, complete and verifiable elimination of nuclear weapons. In this regard, India welcomes the intention of Russia and the United States to conclude a new Treaty on Further Reduction and Limitation of Strategic Offensive Arms. India and Russia stress that the proliferation of nuclear weapons and its possible link to terrorism poses a threat to international peace and security, undermines security of states, complicates progress toward nuclear disarmament and may negatively affect prospects for wider international cooperation in the sphere of peaceful uses of nuclear energy. The Sides pledge to work together for global non-proliferation. The Sides reaffirm their commitment to prevent the deployment of weapons in outer space and to maintain outer space exclusively for peaceful use and cooperation for the sake of all mankind. 7. The Sides are convinced that the international community should enhance efforts to combat terrorism in all its forms and manifestations. The United Nations Global Counter-terrorism Strategy and the respective resolutions of the UNGA and UNSC should be steadfastly implemented, in particular UNSC resolutions 1267, 1373 and 1540. Both Sides call upon the international community to comply with the provisions of international counter-terrorism conventions and protocols including the principle, 'either prosecute or extradite', regarding the persons accused of committing acts of terror. The Sides strongly call for an early adoption of the Comprehensive Convention on International Terrorism. The Sides intend to further develop Indian-Russian bilateral cooperation in combating new challenges and threats, including such cooperation within the framework of the India and Russia Working Group on Combating International Terrorism. Russia expressed solidarity and support to the Government and people of India in connection with terrorist attacks in Mumbai on November 26-29, 2008 and both Sides underscore the need to bring the perpetrators of the attack to justice. India supports Russia's efforts to maintain peace and stability in the Caucasus. India expressed sympathy for the victims of the attack of the "Nevsky Express" by terrorists on November 27, 2009 in Russia, and supports the Government of the Russian Federation in its determination to eliminate terrorism from Russian soil. 8. The Sides welcome the result of the presidential elections in Afghanistan and agree that the people of Afghanistan and the international community face a clear and present danger from terrorist and extremist elements which must be tackled resolutely before peace and stability can be restored in the region. 3. Индия и Россия приняли на себя единые обязательства по реформированию системы глобального экономического управления на базе принципов равноправия и справедливости, принимая во внимание необходимость обеспечить полномасштабное участие ведущих экономик и развивающихся стран в реформировании мировой финансовой и экономической системы, в соответствии с новыми экономическими реалиями. Индия и Россия отмечают, что, несмотря на разнообразие ключевых игроков, действующих на международной арене, и взаимозависимость последствий глобализации, современное государство является основным инструментом для обеспечения баланса общественных интересов и соблюдения прав, свобод и интересов отдельных граждан, а страны являются теми базовыми элементами, из которых строятся международные отношения. 4. Стороны подчеркивают, что, формирующаяся сейчас система международных отношений должна основываться на принципе единой безопасности, иметь универсальный характер и охватывать все страны и все ведущие сферы международных отношений. Стороны отмечают, что поддержание мира между народами предусматривает равную безопасность для всех без исключения стран. Безопасность определенных стран не должна достигаться за счет отказа от обеспечения безопасности других. 5. Стороны убеждены в том, что только коллективные усилия международного сообщества в целом помогут успешно справиться с проблемами, в частности, с преодолением глобального финансового кризиса, обеспечением энергетической и продовольственной безопасности и решением вопросов, вызывающих глобальную озабоченность, например, проблемы климатических изменений. 6. Индия и Россия выражают свою поддержку международным усилиям, нацеленным на глобальное, полное и подтверждаемое уничтожение ядерных вооружений. В этой связи Индия приветствует намерения России и США заключить новое Соглашение о дальнейшем сокращении и ограничении стратегических наступательных вооружений. Индия и Россия подчеркивают, что распространение ядерных вооружений и их возможная связь с терроризмом создают угрозу миру между народами и международной безопасности, подрывают безопасность государств, затрудняют процесс ядерного разоружения и могут оказать негативное воздействие на перспективы более широкого международного взаимодействия в сфере мирного использования ядерной энергии. Стороны обязуются прилагать совместные усилия в целях международного нераспространения. Стороны еще раз подтверждают свои обязательства по недопущению развертывания вооружений в космосе и сохранению космического пространства исключительно для мирного использования и взаимодействия на благо всего человечества. 7. Стороны убеждены в том, что международное сообщество должно упрочить свои усилия в борьбе с терроризмом во всех его формах и проявлениях. Глобальная антитеррористическая стратегия ООН и соответствующие резолюции Генеральной ассамблеи ООН и Совета безопасности ООН должны целенаправленно реализовываться; в частности, речь идет о резолюциях 14 Business Messenger April 2010 The Sides emphasize that the resurgence of the Al Qaeda and Taliban in Afghanistan threatens the progress made over the last few years. In this regard, they condemn the terrorist attack on the Indian Embassy in Kabul on October 8, 2009. They agree that the fight against terrorism cannot be selective, and drawing false distinctions between 'good' and 'bad' Taliban, would be counterproductive. They highlight the need for strict observance of the sanctions regime against persons and entities listed by UNSC Committee 1267. The Sides reaffirm their long-term commitment to a democratic, pluralistic and stable Afghanistan. They are in favour of enhancing the role of the International Security Assistance Forces in combating the illegal narcotics infrastructure in Afghanistan. In this context, India appreciates the convening by the Russian Federation of an International Conference on Afghanistan under the aegis of the Shanghai Cooperation Organisation on March 27, 2009. 9. The Sides share the international community's concern with the continuing acts of piracy and armed robbery off the coast of Somalia. The Sides assert that measures to combat piracy should be implemented in compliance with international law and that persons guilty of acts of piracy must be brought to justice. 10. India and Russia emphasise the urgency of effective international action to combat climate change and in this context, affirm their readiness to continue to work constructively for the success of the UN Conference on Climate Change in Copenhagen in accordance with the principles and provisions of the UN Framework Convention on Climate Change and the Bali Action Plan, bearing in mind the principle of common but differentiated responsibilities and respective capabilities of states. 11. India and Russia agree to enhance bilateral cooperation in the energy sector, including joint projects by Indian and Russian hydrocarbon companies. While promoting bilateral energy cooperation efforts, the Sides also support the modernization of the architecture of the global energy market. The Sides agree to discuss and develop an appropriate international legal system that would promote transactions in the energy sector in a universal, equitable and non-discriminatory manner, taking into account the interests of suppliers, transit states and consumers of energy resources. 12. India and Russia welcome the finalisation of the Agreement on Cooperation in the Use of Atomic Energy for Peaceful Purposes and look forward to developing and intensifying broadbased cooperation between the two countries in the area of nuclear energy including such areas as joint scientific research, implementation of nuclear power projects and setting up of fuel supply arrangements. On these aspects and in regard to the development and intensification of broad-based cooperation as mentioned in the Framework Agreement, the Sides will conclude specific instruments. 13. The Sides consider effective interaction on timely response to natural and man-made disasters and mitigating their social and economic impact as an important sphere of international cooperation. 14. India and Russia call for strengthening bilateral and international cooperation in countering the threat of extremely dangerous infectious and other contagious diseases. 15. In the context of the international financial and economic crisis, they commend the timely and strong policy response for growth, until durable recovery is assured. They reiterate the importance of the comprehensive package of regulatory measures to prevent recurrence of the crisis. The Sides welcome the Pittsburgh Summit's focus to address reforms of the international financial institutions in order to improve their credibility, governance and effectiveness, and look forward to implementing the G-20 decisions within the agreed timelines. The Sides reaffirm their commitment to avoid protectionism in all its forms. The Sides favour the streamlining of the G-20 process, including defining rules of procedure, ensuring transparency in work methods and equitable rotation of G-20 Summits. In a spirit of friendship and cooperation, they look forward to working closely together, as well as with others, in the G20 framework. India and Russia also favour closer cooperation and equal interaction between developed countries and major developing countries in other international formats, including the Heiligendamm - L'Aquila Process. 18. The Sides note the growing efficacy of close multilateral cooperation in the Asia Pacific region as a means to enhance economic cooperation in the region and to maintain regional peace and stability to confront global challenges of security and development of the 21st century. In this context, the Sides express interest in strengthening bilateral and multilateral interaction in different related fields. 19. The Sides consider the interaction in BRIC and RIC formats to be an effective tool to promote strengthening a more balanced and predictable international system as well as a core element to shape a multipolar world order and to ensure sustainable world development in the post crisis setting. 20. Both Sides welcome the progress registered by the BRIC dialogue. They note that the first stand alone BRIC Summit in Yekaterinburg, Russia, in June this year has given it a direction for future growth and added new vistas of cooperation for the coming years. The Sides look forward to early meetings of BRIC Energy and Agriculture Ministers and implementation of other initiatives suggested by the leaders at the first BRIC Summit. Russia is confident that engagement of India in the AsiaPacific Economic Cooperation (APEC) will enhance capacitybuilding and effectiveness of the APEC mechanism, and encourage enhanced trade and investment cooperation in the region. Russia supports India's membership in the APEC and will work towards lifting the moratorium on expanding the APEC's membership. 24. India believes that Russia's involvement in the Asia-Europe Meeting (ASEM) will greatly help to improve interregional cooperation, mutual understanding and confidence within Eurasia, and in this respect India supports Russia joining that dialogue forum at the 8th Asia-Europe Meeting to be held in Brussels in 2010. 25. Consequently, many sectors have to be seriously reviewed and reanalyzed with the aim of putting the right emphasis on the industries, where resultant synergies will not only further enhance the level of business interactions between Russian and Indian corporations, but should also put them in competitive positions on the global marketplace. In this regard, joint actions platforms such as the Indian-Russian Joint Action Group and the Indian-Russian Business Development Council are realistic steps in furthering bilateral cooperation. Also, such major Indian economy growth drivers, notably, the mining, metallurgical, machine building, electrical heavy engineering and energy sectors are just few industries, where significant Russian presence and participation are inevitable. We, the current IBA management team members, and indeed, all the IBA members, are fully aware of the enormity of these tasks, but we take comfort in the fact that the IBA now has a good team and professional management with clear visions on the ways to move forward and achieve these lofty and highly ambitious objectives. Besides, since I’ve become the alliance’s president, I’ve got the impression that the all IBA’s rank-and-file members have come to understand the urgent need for radical changes in the organization’s modus operandi. Indeed, it is this urgency and the yearning from the alliance’s rank-and-file members that have emboldened us to embark on such ambitious missions. And, I must say that we have made a lot of progresses across several issues that we had handled since taking office I need to specially mention that most of the achievements would have been totally impossible, both from logistics and diplomatic points of view, were it not for the relentless efforts of the Indian Embassy in Russia, notably, the head of the mission, His Excellency Ambassador Prabhat Prakash Shukla, and indeed, all the key embassy staff members that have personally been instrumental to laying the solid foundations that guaranteed the glowing successes of most of the IBA’s events under my presidency. Similarly, several russian officals have not only expressed verbal support to most of the IBA’s aspirations, but have also taken concrete steps toward the realization of the alliance’s objectives in Russia. Besides, both countries have lots in common, just as they have lots to learn from one another in order to successfully meet the challenges of development and progress that citizens of both states seriously yearn for. This is not only to enable people to simply know about its existence, but also its capabilities as a strong business lobbyist organization to solve members’ problems, foster cooperation between similar organizations and government agencies. This is why the ties and connections of the alliance members will come very handy. For instance, I have been able to build very good personal connections with the right people in and outside Russia. For instance, several ministers, legislators and other top Russian government officials are clients of The Imperial Tailoring Co., which is my company. Also, we have established very good working agreements with such influential organizations as the St. Petersburg International Economic Forum, which we are planning to use to highlight IBA’s activities in Russia to the international audience, and also have good relationships with all the local business chambers and international business associations in Russia. A) Pharmaceuticals I believe that, Indian pharmaceuticals giants keep main stress on export of their products. Soviet) pharma manufacturers ,at least 20 of them become initiators in new sphere of production plans and invite Indian partners in pharmaceutical industry for formation of joint ventures and at the same time, the Indian giants in Pharmaceutical industry ,to have a serious look into the investment in such venture. Eventually, Russian side has to also think seriously about a part of investment for such a venture and from government side, there has to be a special subsidy on auxiliary and related items .The customs office to be located in the same area to avoid traditional methods of customs formalities which prolong for many days and do not correspond to the international standards. The customs sphere is needed to be simplified for the sake of development of Pharma industry in Russia and to be precise, the customs system in Russia needs to be liberalized and step by step to bring it close to West European standards. As Russia come close to west, some of the European traditions could prove successful in the development of socio-economic life of the country. A.2) Active Participation During early 90's, on the initiative of Russian Government, the Swiss multinational company Nycomed, actively worked on formation of pharmaceutical base in Russia. The "Nycomed-Russia-CIS" , aims to consider strategic plans for development of such industry in Russia, the market of which is understood to reach 20 billion USD in the year 2012-2013. Possibly, it is why the Nycomed Switzerland took a decision to invest S60 million in the development of such industry in Russia. At the same time, a French pharmaceutical company "Servier" opened a S40m plant in the Moscow region in July 2007.It is one of the first to produce active pharmaceutical ingredients (API) in Russia A.3) Indian Pharma Indian giants in Pharma industry could also likewise, participate in pharma production in Russia. India is considered to be having many giants in Pharmaceutical industry :like Hetero Drugs Limited with over 500 Million USD revenues in the production of ingredients ( API) and has approvals of US food and drug administration and World health organization and has presence in over 100 countries.. Then comes, giant "Ranbaxy"( Ranbaxy Laboratories Ltd), which also has operations in 46 countries and has manufacturing facilities in seven countries. The combined company is now worth 30 billion USD. Then we have " Serum Institute of India", one of the leaders in the world to produce immunobiologicals including vaccines . We have then "Cadila"( cadila :aboratories)internationally known company in the production of pharma ingredients ( API) and herbal products. Famous pharmaceutical manufacturers "Cipla", "Dabur IndiaLtd", Dr.Reddy and others . The Pharma industry in India also has its roots of development. It went on procuring licenses from Western partners and further, many European countries shifted their production to India and further, transfer of technology and knowhow and all this process continued for years. At the same time, with the constant assistance from the government and the correct policy of the government, the diversification in this particular area took place. At present, India produces not only raw pharmaceuticals and ready medicine; it also produces now machines and technology for production of ready medicine. India at present exports complete machines for manufacture of ready medicine to Western Europe , Middle East, Latin America and Asia . 36 Business Messenger April 2010 B) Metallurgy In 50-60's, the Soviet Union , built many metallurgical plants in third countries including in India ,famous as " Bhilai and Bukhara". It is now 50 years ago . This time, India is one of the advanced countries in the production of ferrous and non-ferrous metals. The main task of the Russian government at the moment, is to create conditions where it could attract foreign investment, shut down the non effective capacity and intensify measures to crate green environment. On this subject, India could also actively participate in investment on these projects on mutually beneficial terms. May be it could participate in such project jointly with OMZ Russia ( United machine building plant) , one of the share holders of which is now famous URALMASH ( Urals machine building plant).The OMZ produce unique machines for metallurgy including cold press equipment ,Rollers for rolling mills, modern oxygen convertors and so on. These machines are often needed by Indian Metallurgy too and hence there exist huge spectrum for business and joint cooperation. C) Textile Industry in Russia Problems and prospects Following conclusions could be fruitful for those Indian export / manufacturing companies, who consider Russia as their "prey". Yes, the Russian market is huge, mainly for most fashionable items produced in Europe with high standard quality characteristics, satisfying Russian customer's need. For items identified as sportswear, T-shirts (cotton), jeans and so on, Russian market is very attractive. Nevertheless, more than 70% of orders of these items go to China mainly to those specialized manufacturing companies who are located in Ningbo city and cities around Shanghai. This explains the united approach by Chinese and their active participation in major Trade fairs on textile industry in Russia. The Chinese companies produce exact copies of foreign brand items .Indian companies, mainly based in Tamil Nadu, probably do not want to introduce themselves to Russians. They were never found in any major trade fairs at Moscow. According to latest information from organizers of Trade Fair " TextilLegprom" Moscow, almost 60 big Chinese textile product companies have applied for coming trade fair in Autumn at Moscow . During Moscow trade fair in February 2010, only 4-5 Indian companies were found and their stands under the board of "Government of India". The names of these companies could not be found anywhere .They were just small trading companies and in my opinion the exponents they carried with them were of last century and not really meant for European society of Moscow. The most effective variant of entering deeply into Russian market in textile industry is ,the formation of joint venture companies for production of cotton products out of Central Asian raw cotton available in plenty in Russia. The work permit can be obtained by the company which hires the foreign citizen An individual can obtain work permit for him or her only if either he or she is the citizen of the CIS states (excluding Turkmenistan) or has a temporary residence permit in Russia. Foreign citizen either one of the CIS states or having temporary residence permit should apply the FMS and provide all the necessary documents. His or her application will be examined within approximately 10 working days. Company employing foreign citizen should take care of all the necessary work permissions. Work permits to foreign citizens are issued on the basis of annually established quota. Обширная программа Представители БКВДУ (Брахма Кумарис Всемирный Духовный Университет) и сторонники Сахаджа Йоги целый день просвещали гостей праздника. Рассказывали о самореализации и поиске своего пути в жизни. Все время на сцене шла концертная программа с танцами и конкурсами. Собравшихся и хорошо разбирающихся в культуре Индии было такое количество, что конкурсы были не на знания, а на скорость реакции. После этого концерта в пять вечера начинался 4-й Всероссийский Конкурс Индийского Танца. Но перед этим прошел настоящий праздник красок. Разукрашенная с ног до головы группа индусов устроила буйные пляски под национальную музыку. Рядом сразу образовалась толпа заинтересованных, которая вскоре стала всех цветов радуги. Well-known Bollywood actresses Shipra Khazana hosted the entire porgram whom were there to share a bit of the beauty, and Russian artists Nikas Safronov and actor Nikoai Drozev made interesting comments about Russian culture in modern Russia. Nikas Safronov said: "I feel myself to be a child who has come into a child's world of peace, love and happiness". HOLI is not only a spring festival, it is also a festival of equality. This is the only time when Indians forget about caste and join in a general praising of the Gods as equals. Young men in particular enjoy this event. It is the only day of the year they can get close to the girls, through throwing paint. Sammy Kotwani, the president of the Indian business Alliance said: "When the paint is mixed up, it becomes apparent that everyone has become equal. Your white skin is not visible any more, and neither is my dark skin. We are all the same." People become the same before their Gods, and HOLI has fulfilled its purpose, until next spring. The event was organized by the Indian Business Alliance with the solid support of the STP Group of Companies and other sponsors. Целых пять часов без перерывов на сцене звучала индийская музыка и десятки тел выплясывали народные, классические и эстрадные танцы Индии: катхак, одисси, кучипуди, педжаби, boolywood и др. Неудивительно, что к 10 часам вечера, когда пришло время назвать победителей, половина зала уже давно покинула свои места, но как ни странно, и большинство из членов жюри не оказалось на месте. Therefore, particular attention must be paid to Russian business modeling to be made PRIOR setting up legal presence in Russia. There are several forms for a foreign investor to start business in the Russian Federation. Foreign investor may set up (or register) a Russian legal entity in the form of limited liability company, joint-stock company (which can be private or public) or partnership. The other way is to register a representative or branch office of a foreign company in Russia. Starting Up a Business in Russia - Legal Entities Russian legal entity Subdivision of a foreign company Limited liability company (LLC) Private joint stock company (PJSC) Representative office (RO) Branch Legal Status Russian legal entity Limited liability company (LLC) Private joint stock company (PJSC) Legal Status LLC and PJSC are Russian legal entities. They may conduct any form of commercial activity, provided it is not prohibited by the Russian legislation. For conducting any licensed type of activity it is necessary to obtain license. The number of shareholders/participants in PJSC/LLC can not exceed 50. Any Russian and foreign companies and persons may be founders and shareholder in any number of Russian companies. The company may be established by a single founder, as long as the founder is not a company owned by a single legal entity or individual. Some peculiarities exist for the companies with single founder. For more detailed information please see Sole ownership . Registration and Accreditation Registration is done by the Tax authorities, which keep the United State Register. Company also shall be registered with State Committee for Statistics and three non-budgetary funds (Pension fund, Obligatory Medical Security fund and Social Security fund)*. There are also charges for registration of company’s seal, registration at State Committee for Statistics, which amount in general to no more than ~80 USD. Authorized capital Minimum authorized capital for LLC and PJSC is 10,000 rubles (~370 USD) For LLC, at least 50 per cent of the authorized capital shall be paid-up prior to the company’s registration. For PJSC, 50 per cent of the authorized capital shall be paid-up within 3 month upon the registration. Management structure LLC and PJSC have a three-tier management structure consisting of (1) the general meeting, (2) the board of directors, and (3) the executive body**. General meeting is the highest management body and it must meet at least once a year. Board of Directors effects general supervision of the company’s business activities which are not referred to the competition of the General meeting Executive body of a company may be represented by both an individual and collegial body. The executive body acts pursuant to the Charter document and doesn’t need a POA. Shares/Units Authorized capital is divided into shares/units which represent rights and obligations of a shareholder/participant in accordance with their participations in the authorized capital. For LLC's, a unit is not a security. The units can be sold to anyone, but there can be stipulated right of priority for the unit purchase. For PJSC's, a share is a security. Open subscription is prohibited The shares allotment shall be registered with the relevant state body. 54 Business Messenger April 2010 Accounting and Tax Compliance Companies shall file accounting and tax reports with the tax authorities on a quarterly basis. Registration and Accreditation ROs and Branches may be accredited at several state bodies, such as State Registration Chamber (GRP), Chamber of Trade and Commerce and various Ministries of the Russian Government, although the Consolidated State Register of ROs and Branches is kept by GRP. ROs and Branches also shall be registered with the Tax authorities, State Committee for Statistics and three non-budgetary funds (Pension fund, Obligatory Medical Insurance fund and Social Security fund). Chamber of Commerce accreditation is much efficient and faster than GRP registration. Accreditation charge of the GRP for 1, 2, 3 and 5 years accreditation is 60,000 rubles (~2150 USD). There is also a state duty which is also 60,000 rubles (~2150 USD). Sameway, accreditation of branch of a foreign entity can also be done at Chamber of Commerce, which is more efficient and faster. Authorised Capital There is no requirement for the authorized capital for Representative Offices. For branch of a foreign entity, under the Federal law there is a requirement to form assets, but the amount is not stipulated. Management structure For both the RO and B ranch an executive body (Head of RO or Branch) should be appointed by the foreign legal entity. Such executive body acts pursuant to the Power of Attorney issued by the foreign legal entity. Shares/Units - Not Applicable Accounting and Tax Compliance There is almost no distinction between a Branch (or taxable RO) and Russian legal entity in terms of tax compliance. RO which carry out auxiliary and marketing activity also should submit reports on their activities and possible income and all reports related to payroll and social taxes. Reporting is generally done every quarter with exception for VAT (monthly) to the special Tax inspectorate, which deals only with RepOffices and Branches. Sole ownership. As it was mentioned before Limited Liability Company or Private Joint Stock Company can be founded by an individual (Russian or foreign) or by a legal entity. The founding document at Sole ownership company is a Charter. Such company doesn’t have some management bodies such as General Meeting of the Founders. There is no Board of Directors. All the decisions are taken by the sole founder. Accordingly legislative requirements on calling of the general meetings, and other procedural requirements do not apply to such company. The management of the company is done by issue of written decisions of the fonder. If the fonder is also a General Director in the company the decisions are made by issuance of orders. At the same time such company is a separate legal entity, its assets are legally isolated from the assets of the founder. Formation of a Russian legal entity. General information. Types of Taxes. Prospects of Tax Reform in Russia Russian tax system is being constantly reformed. Currently major part of the tax system is regulated by the Tax Code of the Russian Federation, a direct acting law. At the same time, some taxes are established by individual laws of the Russian Federation or constituents of the Russian Federation. Double tax treaties made between the Russian Federation and other countries are an integral part of Russian tax system. Currently over 60 such treaties are in force. Provisions of international agreements and treaties supersede national legislation (See Appendix 1). Russian taxes are divided into federal, regional and local (See Appendix 4). Taxation of Foreign Legal Entities in the Russian Federation Taxation of foreign legal entities in Russia depends on whether they carry out entrepreneurial activities in the territory of Russia via a permanent establishment or not. 1. Recognition of Permanent Establishment In accordance with the Tax Code of the Russian Federation permanent establishment for the purpose of the profits tax shall mean any "separate subdivision" or another place of business of a foreign entity via which the organisation regularly carries out entrepreneurial activities in the territory of the Russian Federation relating to the use of subsoil and (or) other natural resources, performance of contractual services for the construction, installation, assembly, start-up and commissioning, maintenance and operation of equipment, selling of goods from warehouses located in the territory of the Russian Federation that are owned or leased by such entity, performance of work and carrying out other services, carrying out other activities, provided such activities are not preparatory or auxiliary activities rendered to such foreign entity. Activities of a dependent agent of a foreign entity may lead to permanent establishment of such foreign entity in the territory of the Russian Federation. Therefore, three characteristics are necessary to recognise that a foreign entity forms permanent establishment in Russia, which are as follows: 1 A foreign entity has a "separate subdivision" or any other place of business in the Russian Federation, 2 A foreign entity carries out entrepreneurial activities in the territory of the Russian Federation, 3 A foreign entity carries out entrepreneurial activities on a regular basis. Most double tax treaties deal with cases when a "separate subdivision" that performs supporting or preparatory activities does not form permanent establishment. Preparatory or supporting activities must be carried out in the interests of the foreign entity, not in the interests of third parties. It is noteworthy that in case preparatory or auxiliary activities constitute the whole or part of primary activities, such activities may be regarded as reasons leading to permanent establishment in the Russian Federation, provided relevant characteristics are available. Generally, the fact that a foreign entity owns property in the territory of the Russian Federation cannot be regarded as leading to the permanent establishment of such entity in the territory of the Russian Federation. Nevertheless, under some circumstances the use of such property for commercial purposes may lead to the formation of permanent establishment of a foreign entity. For example, if a foreign entity regularly leases out the property it owns, looks for tenants, makes lease agreements, makes contracts for current repair and maintenance of the premises, etc, such activities of a foreign entity may lead to the formation of permanent establishment in the Russian Federation. When qualifying activities of a foreign entity providing personnel for working in the territory of Russia, Russian tax authorities may recognise them as those leading to permanent establishment if the foreign entity also renders other services or when the amount of remuneration for the personnel provided significantly exceeds (by over 10%) the normal amount of wages and benefits (travel expenses, accommodation allowances, etc). Thus, the term "permanent establishment" is a combination of characteristics and evaluations of activities of a foreign entity required to qualify activities of a foreign legal entity as leading to the permanent establishment in the territory of Russia and, therefore, obligation of a foreign entity to pay the income tax in the Russian Federation. 2. Taxation of Foreign Legal Entities that do not Carry out Entrepreneurial Activities in the Territory of Russia via Permanent Establishment Value Added Tax Foreign legal entities selling goods, performing work and providing services in the territory of Russia are payers of the value added tax. The territory of Russia is recognised as a place of performing work and rendering services in the following cases: if work and services are directly related to immovable property located in the territory of Russia. Among other things, such work (services) includes construction, assembly, repair and renewal services; if work (services) is connected with movable property located in the territory of the Russian Federation; if services are actually provided in the territory of Russia and refer to the field of culture, art, education (training), physical culture, tourism, recreation and sport; Russia is regarded as a place of providing certain services and performing certain work if the purchaser of these services and work actually operates in the territory of Russia. Such work and services include, among other things, the following: transfer or granting of patents, licenses, trade marks, copyrights or other similar rights (royalty); advisory, legal, accounting, engineering, advertising, marketing, data processing, research and development services; leasing out of movable property, except land transportation vehicles; services of an agent engaging, on behalf of the principal, another party (an entity or an individual) for performing the above specified services; If work or services performed or rendered by a foreign company are subject to the value added tax and the foreign company is not registered with tax authorities of Russia, the purchasers of such work and services, registered taxpayers (legal entities and entrepreneurs), act as tax agents. A tax agent is obliged to compute and withhold the tax and transfer it to the federal budget of Russia. This procedure is similar to VAT reverse charge in Europe. In accordance with Article 174 of the Russian Federation Tax Code the value added tax is to be withheld by the tax agent at the moment funds are transferred to the foreign company. According to Russian arbitration court practice, if a contract with a foreign company provides for in-kind settlements, the purchaser of goods, work, services has no possibility to withhold funds in order to transfer them to the budget and, therefore, purchasers of such goods, work and services cannot fulfil their tax agent's liabilities with respect to the value added tax. In this case purchasers of goods, work and services are obliged to inform tax authorities at the place of registration of impossibility to . . . . . . . 64 Business Messenger April 2010 withhold the value added tax from a foreign company. Therefore, the foreign company is still in debt to the Budget on value added tax. This might be crucial in the case when a foreign company possesses some property located in Russia, and Russian tax authorities may seize the property. Due to the explanations made by tax authorities value added tax must be withheld by a tax agent even when a foreign company has a permanent establishment in Russia registered with Russian tax authorities, and this permanent establishment is not involved in performing work (rendering services). Income Tax Tax legislation of Russia regulates taxation of foreign legal entities carrying out no entrepreneurial activities in the territory of Russia via permanent establishment in the Russian Federation and deriving income from the sources in the Russian Federation. Such income includes dividends paid to a foreign company holding shares in Russian companies; interest income from any debt instruments, including profit sharing bonds and convertible bonds; income from exercising intellectual property rights in the Russian Federation; income from the sale of shares (participatory interests) of Russian companies where over 50 per cent of the assets is immovable property located in the territory of the Russian Federation; income from selling immovable property located in the territory of the Russian Federation; income from lease or sublease of the property used in the territory of the Russian Federation; income from international transportation operations, except cases when the point of departure and the point of destination are located outside the borders of the Russian Federation; fines and penalties for violation of contractual obligations by Russian entities and governmental bodies; other similar income. The income tax is calculated, withheld and paid to the budget (at the rate of 20% of the total income amount) by the tax agent - the source of income. Personal Tax If the double tax treaty between Russia and the state of residence of the foreign company provides for a reduced tax rate or exemption for the income gained in Russia (See Appendix 1), the foreign company must provide the tax agent (income payer), prior to the income payment date, with a confirmation that this foreign company is permanently located in this state. Otherwise the tax agent will be obliged to withhold the tax. However, a foreign company has the right to apply for tax refund to Russian tax authorities within three years from the end of the tax period when the income was paid. Basic Corporate Taxes Paid by Tax Residents in Russia 3. Taxation of foreign legal entities carrying out entrepreneurial activities via permanent establishments located in the territory of Russia Foreign companies carrying out entrepreneurial activities via permanent establishments located in the Russian territory have tax obligations equal to Russian companies: value added tax, profits tax, property tax, unified social tax and other. Value Added Tax The value added tax is a federal tax and is payable to the federal budget of the Russian Federation. Taxpayers are Russian companies, foreign companies and entrepreneurs without forming a legal entity. Provided the gross income from sales of goods, work, services for three consecutive months did not exceed two million roubles, the taxpayer may be exempted from taxpayer obligations with respect to the value added tax. Taxable shall be the sales of goods, work and services in the territory of the Russian Federation, imports to the customs territory of the Russian Federation, transfer of goods for own consumption. Besides, performance of construction and assembly work for own purposes is also subject to VAT but relevant VAT can be immediately recovered from the budget. The Russian Federation is regarded to be the place of performing work and providing services in case the purchaser of such work and services is registered (with tax authorities) in the territory of the Russian Federation. This rule applies to advisory, legal, accounting, advertising, marketing, engineering and data processing services. The Tax Code specifies goods, work and services that are exempt from the value added tax. When importing goods to the territory of the Russian Federation the value added tax is charged on the value of goods equal to the amount of contractual value of goods and customs duties. Starting from 01.01.2006 all taxpayers are obliged to determine the tax base using accrual method, i.e. as goods, work, services are sold. The tax is charged at the rates of 0%, 10% and 18%. Exported goods, work, services are subject to VAT at the rate of 0%. Exporters have the right to refund VAT amounts they paid to their suppliers on goods, work and services that were used for the production and sale of exported products. Nevertheless, the procedure of VAT refund is extremely complicated. Foreign companies may offset or refund the amounts of value added tax paid on goods imported to the territory of Russia or paid on goods, work or services purchased in the territory of Russia after registration with tax authorities of the Russian Federation. According to general rules the right to offset the value added tax may be exercised within three years after such right occurred. According to the Tax Code of the Russian Federation, when calculating the value added tax due to the budget, amounts relating to the payments for goods, work and services must be taken into account. Such revenues include advance payments, other payments made for future supplies subject to the valued added tax, amounts of interest on promissory notes and bonds contributed as payment for goods, work, services, interest on a tied credit. Generally, VAT amounts paid to suppliers of goods, work, services shall be offset if such goods, work and services were used for the operations subject to VAT. VAT amounts may also be offset in case the goods, work and services sold are subject to a VAT of 0%. In some cases VAT amounts paid to the suppliers of goods, work, services are added to the profits tax deductible expenses (for example, if they are used for VAT exempt operations). Suppliers must provide their purchasers with VAT invoices (schet-faktura) no later than 5 days after goods, work or services were provided. Tax period with respect to VAT is one quarter. Starting 3rd quarter 2008 VAT is payable in the amount of 1/3 of VAT due for the quarter by 20th of each month of the following quarter. For example, VAT for the 3rd quarter 2008 must be paid by 20 October, 20 November and 20 December in equal parts. Earlier VAT was paid by 20th of the month following the tax period in full amount. 65 Business Messenger April 2010 In a number of cases offset VAT amounts are to be recovered and paid to the budget. For example, when goods or other property are contributed to the charter of a subsidiary. According to the Tax Code of the Russian Federation, contribution of property to the charter capital is not regarded as sales and, therefore, is not subject to the value added tax. In case the expenses on goods, work and services are partially tax-deductible (e.g., entertainment expenses, advertising expenses), VAT paid on such goods, work, services is recoverable in proportion to tax-deductible expenses. Profits Tax Foreign companies carrying out entrepreneurial activities through permanent establishment located in the territory of Russia shall pay the profits tax on all income received from activities of such a permanent establishment (part of the worldwide income of a foreign company received from activities of a permanent establishment may also be subject to taxation). Profit of a foreign company received as a result of activities of permanent establishment is subject to the profits tax in accordance with generally estblished procedures similar to Russian companies. At the same time, a number of double tax treaties provide for a possibility for foreign companies to include into tax deductible expenses incurred by the head office in connection with commercial activities of the permanent establishment or specific expenses subject to no restrictions established by law (advertising expenses, entertainment expenses, travel expenses, etc). If a foreign company carries out preparatory or supporting activities on behalf of third parties in the territory of the Russian Federation leading to permanent establishment when no remuneration is envisaged for such activities, the tax base Value Added Tax may be determined at 20 per cent of expenses incurred by such permanent establishment on such activities. The profits tax is regulated by Chapter 25 of the Tax Code of the Russian Federation. The tax period is a calendar year. Before 2009 basic tax rate was equal to 24%. The tax was allocated to various budget levels: to the Federal budget - 6,5%, to the budget of the constituent of the Russian Federation - 17,5%. Starting 2009 Profits tax rate is reduced from 24 to 20%. As a result of the adjustment the Federal part of the Profits tax rate was shifted from 6,5 % down to 2,0% while the Regional part was increased from 17,5% to 18%. Financing of a Russian Subsidiary by Founders According to the law, the property contributed by a founder whose share in the charter capital exceeds 50 per cent is not subject to the profits tax provided such property (except cash) is not transferred to third parties within one year from the moment it was received. Dividends For a foreign company drawing dividends from a Russian company the profits tax rate is equal to 15 per cent. In case a Russian company receives dividends from its Russian or foreign subsidiary Profits tax from the amount of those dividends is charged at the rate of 9 per cent. Dividends received by a Russian company are taxable at a rate of 0% in case the following conditions are met: o at the moment of issuing the decision the named Russian company owns for not less than 365 calendar days at least 50% share of the company paying dividends or depositary receipts, giving it right to receive at least 50% of the total amount of dividends paid. o the cost of acquiring the share or depositary receipts of the company paying dividends exceeds 500 millions Russian Rubles. Recognition of Income for the Purposes of the Profits Tax In accordance with Chapter 25 of the Tax Code of the Russian Federation there are two methods of recognising income - accrual basis method (i.e. as goods, work, services are sold) and cash basis method (i.e. as payments for goods, work and services are received). The method should be established by accounting policies of the taxpayer. Meantime, cash basis is available only in case average revenue (net of VAT) for the last 4 quarters did not exceed 1 mln Roubles for each quarter. Tax Deductible Expenses Applicable tax legislation allows to account expenses pertaining to the production and sale of goods, work, services as tax deductible, provided such expenses are economically justified and certified by relevant documents. The Tax Code sets deductibility restrictions only with respect to specific types of expenses, such as expenses on the training of personnel, entertainment expenses, expenses on certain types of advertising. Please note that starting 2009 30 % of initial value if specified groups of fixed assets can be deducted for tax purposes immediately while for the rest depreciation mechanism applies. Losses incurred by the taxpayer may be carried forward during 10 years in full amount. Starting Profits tax return of financial year 2007 restrictions on amount of loss to be carried forward are abolished. Expenses on the interest on any type of loan are deductible within the limits of an average interest on similar debt obligations of the taxpayer in the same reporting period (quarter or month). In the absence of similar debt obligations interest is tax deductible within the following limits: on the loan received in Russian roubles - within the limits of the refinancing rate of the Central Bank of the Russian Federation multiplied by 1.1 index; on the loan received in foreign currency - within the limits of 15 per cent per annum. For certain periods of the years 2008-2010 deductible limits were increased as follows: o For the period from September 01, 2008 to July 31, 2009 interest limit in regard to loans in Russian rubles equals 1,5 times the refinance rate of the Central Bank of the Russian Federation, in regard to loans in foreign currencies is equal 22 percent per annum; For the period from August 01, 2009 to December 31, 2009 interest limit in regard to loans in Russian rubles equals 2 times the refinance rate of the Central Bank of the Russian Federation, in regard to loans in foreign currencies is equal 22 percent per annum; . 66 Business Messenger April 2010 . For the period from January 01, 2010 to June 30, 2010 interest limit in regard to loans in Russian rubles equals 2 times the refinance rate of the Central Bank of the Russian Federation, in regard to loans in foreign currencies is equal 15 percent per annum; In case further amendments to the Tax Code are not adopted, starting July 1, 2010 regular limits will apply, i.e. on the loan received in Russian roubles - refinancing rate of the Central Bank of the Russian Federation multiplied by 1.1 index; on the loan received in foreign currency - 15 per cent per annum. If a loan is received from an affiliated person, "thin capitalisation" rule shall apply. Thin capitalization ratio isstipulated as 3:1. In accordance with the Tax Code, region authorities of the Russian Federation may decrease the tax rate due to the regional budget by no more than 4 per cent. Double Tax Treaties If a double tax treaty between Russia and the state of residence of a foreign company provides for a reduced tax rate or a tax exemption in Russia (See Appendix 1), such foreign company shall provide the tax agent (payer of income) with documents confirming its permanent residence in the state with which Russia has double tax treaty prior to the date of income payment. Otherwise the tax agent will be obliged to withhold the tax. However, a foreign company has the right to apply to Russian tax authorities for tax refund within three years after the expiration of the tax period when income was paid. Property Tax Property tax is a regional tax and established by the Russian Federation Tax Code and by constituents of the Russian Federation. Tax base - net book value of fixed assets. The tax base is determined on the basis of the book value of the assets. The tax rate may not exceed 2.2 per cent. For example, tax rate in Moscow is 2.2 per cent. Reporting period is a quarter. The legislation provides exemptions on specific types of property. A number of double tax treaties between the Russian Federation and other states, for example, Agreement between the Russian Federation and the Federal Republic of Germany on the Avoidance of Double Taxation on Income and Property Tax exempts the property of permanent establishments from the tax provided the property is not used for commercial activities. Unified Social Tax (effective before January 1, 2010) This tax forms revenues of Federal budget and off-budget funds, such as Pension Fund, Mandatory Medical Insurance Fund, Social Insurance Fund. Descending unified social tax scale was applied. Maximum rate was equal to 26% (see Appendix 2). The unified social tax was charged on all payments made to individuals under labour contracts, other contracts rendering works and services, copyright agreements, etc. providing those payments reduce taxable profit. Wages of foreign nationals residing in the Russian Federation on a temporary basis (e.g., employees of permanent establishments of foreign companies or foreign nationals employed by Russian companies) were to be included into the unified social tax base. Insurance contributions (effective starting January 1, 2010) Starting from 01.01.2010 Unified Social Tax is replaced by Insurance contributions. Insurance contributions are made to Pension Fund, Mandatory Medical Insurance Funds and Social Insurance Fund. Insurance contributions are levied on annual cumulative income of each individual not exceeding 415 k RUR (this limit is subject to indexation each year). Insurance contributions on the annual remuneration in the excess of the above limit are not charged. Descending scale is not applied. Rate for the year 2010 is equal to 26%, and will be increased up to 34 % starting 2011 (see Appendix 3). Insurance contributions are charged on all payments made to individuals under labour contracts, other contracts rendering works and services, copyright agreements, etc. regardless these payments reduce Profits tax base or not. Wages of foreign nationals residing in the Russian Federation on a temporary basis (e.g., employees of permanent establishments of foreign companies or foreign nationals employed by Russian companies) are not to be included into the Insurance contributions base (in contrast to rules applied to Social tax before). Individual Income Tax Tax residents of the Russian Federation are payers of individual income tax from their worldwide income. As for non-residents only income from Russian sources is subject to Individual Income tax. Tax residents are defined as individuals who stay not less than 183 days in Russia during previous 12 months. This period includes time when individual was absent in Russia due to medical or education reasons within 6 months. This order is effective since January 1, 2007. Currently a system of flat rates is applied for the purpose of taxation of individuals' income. The basic rate is equal to 13 per cent. Some types of income are subject to other tax rates. Thus, for example, income received in the form of dividends is subject to a 9 per cent rate. The tax shall be calculated, withheld and paid by the source of income. Some specific types of income including, but not limited to, deposit interest, grants, prizes, and interest savings are subject to the individual income tax at the rate of 35 per cent. Income obtained by non-resident individuals is subject to the rate of 30 per cent. When determining taxable income tax residents may apply standard tax deductions, property tax deductions, social tax deductions, professional tax deductions. Individuals, including foreign nationals, residing in the territory of the Russian Federation on a temporary basis are obliged to file tax return not later than 30 April of the year following the reporting tax year in the following cases: receiving income from a foreign entity; sale of personal property; other cases when Individual Income tax was not withheld by a tax agent. Tax return shall not be filed in any case when Individual Income tax is withheld by a tax agent. Moreover, foreign nationals are obliged to file tax return one month prior to intended departure from the Russian Federation provided they are not planning to come back to Russia in the same calendar year. . . . 68 Business Messenger April 2010 IBA NEW YEAR CELEBRATION 70 Business Messenger April 2010 Российско-индийское военно-техническое сотрудничество Общеполитические и экономические предпосылки российско-индийского военно-технического сотрудничества Российско-индийские военно-экономические связи занимают совершенно особое место во всей системе военно-технического сотрудничества РФ. Политическое, военное и промышленно-технологическое значение индийского рынка для России превышает ценность любого другого рынка, включая китайский. Прежде всего, необходимо отметить исключительную военно-политическую гармонию российско-индийских военно-экономических связей. Вероятно, ни одна страна в мире не заинтересована в индийском военном росте и технологическом прогрессе в такой степени как Россия. Россия категорически заинтересована в появлении новых полюсов военной и экономической мощи глобального значения, которые при этом сохраняли бы свою культурную идентичность и политическую субъектность, а не были бы сателлитами единственной оставшейся сверхдержавы. Индийское позиционирование в мире полностью отвечает этому представлению Москвы. И Россия, и Индия вынуждены вести тяжелую борьбу с интернациональными исламскими экстремистскими движениями, деятельность которых координируется на международном уровне, и это делает две страны объективными союзниками в деле глобального антитеррористического сопротивления. Наконец, и Индия, и Россия, не могут закрывать глаза на стремительный военный рост Китая, с которым обе наши страны имеют границы колоссальной протяженности. При этом следует иметь ввиду, что какого бы прогресса не достигла Индия в области строительства своих Вооруженных сил и оборонной промышленности, этот рост никоим образом не будет затрагивать российские интересы безопасности. Как представляется из Москвы, Россия также является для Индии весьма привлекательным, а в ряде случаев – безальтернативным партнером. Российские системы вооружений в большинстве случаев имеют весьма привлекательные показатели по соотношению «эффективность/стоимость». Очевидно, что на рынке присутствуют более высокотехнологичные по сравнению с российскими предложения, однако стоимость этих европейских, американских и израильских систем гораздо выше. Аналогичным образом, при современном состоянии рынка вооружений и военной техники, нетрудно получить доступ к более дешевой по сравнению с российской продукции, однако вряд ли боевая эффективность этих изделий и качество послепродажного обслуживания удовлетворят индийских военных. Российско-индийские программы в области ВВС Наиболее масштабные программы российско-индийского военно-технического сотрудничества развиваются в области авиации и военно-морского флота. Крупнейшей с коммерческой, и наиболее важной со стратегической и промышленно-технологической точки зрения российско-индийской программой в области военно-воздушных сил бесспорно является проект по разработке, поставке товарной партии и последующей организации лицензионного производства в Индии многофункционального истребителя Су-30МКИ. Данная программа является беспрецедентной не только для российского и индийского авиастроения, но и для мировой практики военно-экономических отношений. По спецификациям индийских ВВС с 1996 года ОКБ «Сухого» провело НИОКР по созданию на базе платформы истребителя-перехватчика Су-27 принципиально новой системы авиационного вооружения, аналогов которой в мире нет. После выполнения программы поставок и лицензионного производства Индия будет обладать примерно 300 Су-30МКИ. Реализация программы Су-30МКИ будет иметь колоссальные стратегические последствия. В результате ее выполнения индийские ВВС войдут в число трех-четырех наиболее мощных и эффективных военно-воздушных сил мира. Особое значение имеет тот факт, что после развертывания всей группировки этих машин существующий количественный и качественный отрыв индийских ВВС от пакистанской военной авиации станет непреодолимым. Весьма интересная картина вырисовывается и при сравнении индийской и китайской программы закупок российских тяжелых истребителей. Другой весьма перспективной программой российско-индийского военно-технического сотрудничества в области военновоздушных сил является проект создания и серийного производства оперативно-тактического транспортного самолета Ил214/MTA. Программа находится в самой начальной стадии, не закончено даже определение технического облика самолета, который скорее всего будет создаваться по спецификациям индийских ВВС. Характерно, что с российской стороны в проекте помимо ФГУП «Рособоронэкспорт» и ОКБ им. Ильющина принимает участие Иркутское авиационное производственное объединение, которое является основным партнером Индии и по программе Су-30МКИ. Если программа MTA будет реализована, она положит начало чрезвычайно важному процессу, а именно, гармонизации национальных военно-технических политик России и Индии. Дело в том, что при сохранении заявленного индийскими ВВС заказа на 50 таких самолетов российские военно-воздушные силы вынуждены будут ориентироваться на комплектование своего парка самолетами Ил-214. Альтернативные программы оперативно-тактических военно-транспортных самолетов будут либо закрыты, либо заморожены. Развитие ситуации по данному варианту среди прочего будет означать повышение требований к Ил-214/MTA, тактикотехнические характеристики которого будут подтянуты к ТТХ Ан-70 и Ту-330. Укрепление военно-морских сил Индии История российско-индийского военно-морского сотрудничества началась в конце 60-х годов, когда СССР начал поставки в Индию подводных лодок и сторожевых кораблей. В 1971 году индийские ВМС получили первые ракетные катера, которые спустя всего несколько месяцев были с большим успехом использованы во время вооруженного конфликта с Пакистаном. Сначала катера потопили пакистанский эсминец и тральщик, а в ходе второго набега ракетному обстрелу был подвергнут порт Карачи. Пакистанские ВМС оказались полностью деморализованными, поскольку не могли ничего противопоставить абсолютному огневому преимуществу ВМС Индии. Важным этапом наращивания индийской военно-морской мощи стала программа строительства на советских верфях серии эсминцев проекта 61МЭ. Развитием этого проекта стали эсминцы собственно индийского проекта и постройки класса Delhi. Индийские корабелы доказали, что способны создавать чрезвычайно мощные и весьма сбалансированные корабли, которые по своим интегральным качествам вполне могут считаться одними из лучших. Еще одним показательным элементом совет- 71 Business Messenger April 2010 ско-индийского военно-технического сотрудничества стала сдача в аренду ВМС Индии советской атомной подводной лодки К-43 проекта 670. Индийские ВМС эксплуатировали эту лодку, получившей название S81 Chakra, с января 1988 по 1991 год. Хотя всего через три года ПЛА пришлось вернуть СССР по политическим причинам, эксплуатация этого подводного корабля наглядно продемонстрировала руководству индийского флота большое боевое значение подобных систем вооружений. После распада СССР Россия продолжила снабжать Индию высокоэффективными военно-морскими вооружениями. Индийский флот получил четыре дизель-электрические подводные лодки класса «Варшавянка», кроме того, еще четыре таких же ранее полученных корабля прошли модернизацию на российских верфях, в ходе которой получили чрезвычайно мощный и дальнобойный ракетный комплекс Club-S. Помимо феноменального повышения противокорабельных возможностей индийского флота, особое стратегическое значение имеет приобретение Индией ракет 3М14Э, которые могут применяться по наземным целям. Индия входит, таким образом, в закрытый клуб государств, способных наносить высокоточные удары по административным, экономическим и военным объектам противника с использованием морских надводных и подводных платформ. Другой крупный и во многом уникальный проект российско-индийского военно-технического сотрудничества начался в 1997 году, когда индийские ВМС заказали три фрегата проекта 1135.6, постройка которых осуществляется на «Балтийском заводе». Подобно тому как истребитель Су-30МКИ был создан на базе блестящей платформы перехватчика Су-27, данные фрегаты являются развитием одного из самых удачных советских кораблестроительных проектов – большого сторожевого корабля класса «Кривяк». Также как истребитель Су-30МКИ, проект корабля создавался под специальные требования заказчика, содержит много инноваций и предусматривает интеграцию подсистем иностранного производства. Главным оружием фрегата является все тот же ракетный комплекс Club-N, кроме того, эти корабли несут мощный ЗРК «Штиль-1» и новую легкую автоматическую артиллерийскую установку А-130. Обводы корпуса фрегатов свидетельствуют о стремлении придать им минимальную радиолокационную заметность. Помимо закупки в России новейшего ракетного комплекса Club, Индия вскоре станет обладателем еще более мощного РК PJ-10, который разрабатывается индийской DRDO совместно с российским НПО «Машиностроения» из Реутова. Эта ракетная система отличается сверхзвуковой скоростью на всем участке полета, а также тем, что ее базирование возможно не только на корабельных, но также авиационных и наземных платформах. Подобно проекту транспортного самолета MTA, в данном случае речь идет о действительно совместной программе, реализуемой на основе раздела рынков, технических рисков, а также на базе паритетного финансирования. Одновременно с впечатляющим наращиванием ракетной мощи своего флота Индия предпринимает усилия по созданию группировки средств для выдачи целеуказания своим дальнобойным ракетным комплексам. Индийский флот заказал 9 вертолетов дальнего радиолокационного дозора Ка-31 и несколько прицельно-навигационных систем «Морской змей», обладание которыми значительно повысит возможности по поиску и уничтожению вражеских подводных лодок. Наконец, наиболее масштабным и значительным по своим последствиям российско-индийским проектом в военно-морской области станет передача Индии российского авианесущего крейсера «Адмирал Горшков», который в индийском флоте получил название Vikramaditya. После передачи в декабре 2012 года этого корабля заказчику Индия станет четвертым после США, Франции и России государством, обладающим кораблем, с которого оперируют палубные самолеты горизонтального взлета. Для формирования авиагруппы крейсера индийские ВМС разместили два контракта на закупку в общей сложности 45 палубных многоцелевых истребителей МиГ-29К. Курс – создание единого военно-экономического пространства Процессы глобализации и интернационализации также затрагивают военно-экономическую сферу, как и любую другую область экономики или политики. Во всем мире наблюдается быстрое развитие процессов создания международных оборонно-промышленных альянсов и интернационализации военного производства. Стоимость современных систем вооружений достигает таких величин, что большинство национальных экономик уже не могут обеспечить разработку и крупносерийное производство военной техники нового поколения. Поэтому европейские, например, страны, объединяют свои усилия для реализации больших авиационных, ракетных и космических программ. Одновременно происходит и процесс создания трансатлантического военно-экономического пространства. Нетрудно заметить, что возникающие международные военно-экономические поля совпадают с контурами политических союзов и цивилизационных альянсов (если оперировать в терминах спорной, но безусловно интересной гипотезы Самюэла Хантингтона). Россия и Индия вне всякого сомнения не могут избежать влияния этих процессов. Но обе страны должны разделить важную для себя дилемму – стремиться интегрироваться в уже существующие или формирующиеся альянсы, или попытаться выступить в качестве автономного оборонно-промышленного полюса, альтернативного европейскому и трансатлантическому. На наш взгляд, существует целый ряд аргументов в пользу более амбициозного выбора. Во-первых, это уже отмеченная нами гармония военно-политических интересов России и Индии. Во-вторых, технологическая и научно-техническая комплиментарность. Так, Россия пока обладает более значительным научно-техническим заделом по целому ряду военных технологий, особенно в области авиа-, ракето- и кораблестроения, а Индия является несомненным лидером в области программного обеспечения, в ряде случаев более современными и эффективными основными фондами. Россия и Индия являются также оптимальными партнерами вследствие сопоставимого финансово-экономического потенциала. Немаловажную роль играет и примерно одинаковый уровень эффективности государственной бюрократии. Пилотными проектами по формированию единого оборонно-промышленного поля можно считать проекты BraMos по созданию противокорабельной программы PJ-10, организацию лицензионного производства Су-30МКИ и программа Ил214/MTA. Однако все эти проекты следует рассматривать лишь как первые элементы формирования единого оборонно-промышленного пространства. This is in conformity with the IBA's founding members' aim of creating a platform to guide Indian businesspeople in Russia as well as other Indian entrepreneurs from India and all over the globe contemplating on relocating parts of their local and global businesses to this country. From a modest beginning of a few members in 1996, the IBA today is an officially registered non-profit organization with over 130 members, which has been playing a very significant role in the promotion of Indian businesses in Russia since its formation. The alliance's members span almost all the major manufacturing fields, including pharmaceuticals, engineering, textiles, chemicals, metals, sugar, plastics, tourism, different services sectors and other industries. The IBA has recently started offering membership to non-Indian companies and individuals and the management expects to increase the current membership of over 130 to 300 by the end of this year. The IBA works as a bridge between India and Russia and facilitates favorable business conditions for foreign businesses in Russia. It endorses all solutions to trade and investment issues that protect and benefit its members' interests, supports greater co-operation between Indian companies and their Russian partners and provides timely and accurate information on the Russian market. The IBA regularly organizes seminars, workshops and other relevant programs on key subjects of topical importance as well as holds regular dialogues with various ministers, top government officials and other experts - all aimed at finding quick and effective solutions to its members' problems. IBA's various committees closely monitor industries in both countries and organizes roundtables, etc. with the key industry leaders and relevant government officials. The IBA has a very active regional program, which includes trade missions, familiarization of members with trade and investment prospects across Russia. For instance, the IBA, acting in close cooperation with the Indian Embassy in Moscow, has sent trade missions to more than 45 regions of Russia in the past 2-3 years. The IBA also organizes numerous business meetings with different foreign dignitaries and delegations from abroad and has signed over 10 memorandums of understanding (MOUs) with different Chambers of Trade and Commerce Associations for strengthening bilateral trade through joint ventures, investments, technology transfers between IBA members and those of the respective Chambers of Commerce and Trade Associations with whom such agreements have been signed. The IBA actively represent its members' interests, especially within the framework of the Indian-Russian Joint Commission. Extracurricular activities The IBA is not only a business alliance overseeing the corporate affairs of its members, but also a social organization, which periodically organizes social events aimed at bonding the Diaspora closer, such as picnics and other holiday events, where members can come with their families and meet other people in a more casual atmosphere.
